The terms and conditions for using Sputni Live.

These Terms of Service ("Terms") govern your access to and use of the Sputni Live streaming platform, website, and related services (the "Service") operated by Sputni Live GmbH ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
By registering for an account, accessing the Service, or clicking "I agree", you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.
You must be at least 16 years old to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement under German and EU law.
To access most features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
We offer paid subscription plans (Pro and Premium) alongside a free plan. The prices for each plan are displayed on the pricing section of our website and are quoted in RUB, USD, or EUR at your election. Paid subscriptions are billed monthly in advance. By subscribing to a paid plan, you authorize us or our payment service provider to charge the applicable fees to your designated payment method.
All prices include applicable value-added tax (VAT) at the statutory rate. Where VAT is not applicable (e.g., intra-community supplies with a valid VAT ID), prices are adjusted accordingly at checkout.
We may change our fees and pricing upon reasonable advance notice. Fee changes take effect at the start of your next billing cycle following the notice. You may cancel your subscription before the change takes effect to avoid being charged the new fee.
As a consumer domiciled in the European Union, you have the right to withdraw from your subscription contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of the conclusion of the contract. To exercise your right of withdrawal, you must inform us at Sputni Live GmbH, Friedrichstraße 68, 10117 Berlin, Germany, or by email at support@sputni.live, by means of a clear statement of your decision to withdraw.
Please note that, pursuant to Article 16(m) of the Consumer Rights Directive, the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if you have given your express consent to begin the performance of the contract during the withdrawal period and have acknowledged that you thereby lose your right of withdrawal.
If you withdraw from your subscription within the 14-day withdrawal period, you will receive a full refund of the subscription fees paid, unless you have expressly consented to the immediate provision of digital content and acknowledged the loss of your right of withdrawal. Refunds are processed to the original payment method within 14 days of receiving your withdrawal notice. Fees for partially used billing periods outside the withdrawal window are non-refundable.
You retain all ownership rights in content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, use, display, reproduce, adapt, modify, publish, and distribute that content for the purpose of operating and providing the Service. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate the rights of any third party.
You agree not to: use the Service for any unlawful purpose; infringe the intellectual property rights of others, including by streaming copyrighted movies or games without authorization; upload content that is defamatory, obscene, or harmful; attempt to gain unauthorized access to any part of the Service; interfere with the proper functioning of the Service; or use automated systems (bots, scrapers) to access the Service in a manner that sends more requests than a human can reasonably produce.
The Service, including its design, text, graphics, logos, and software, is the intellectual property of Sputni Live GmbH and is protected by German and international copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
You may cancel your account or subscription at any time through your account settings or by contacting us. Cancellations take effect at the end of your current billing period. We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, all licences granted to you will cease, and we may delete your account and User Content.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, conditions, and representations relating to the Service. Our liability for any claim arising out of or relating to the Service shall not exceed the amount you have paid us in the three months preceding the event giving rise to the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data.
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, you may also bring proceedings in the courts of the EU member state in which you are domiciled. The courts of Berlin, Germany, shall have exclusive jurisdiction over any disputes between us, except where mandatory consumer-protection law provides otherwise.
We may modify these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
