This Privacy Policy explains how Sputni Live GmbH ("we", "us", or "our") collects, uses, and discloses your personal data when you use our streaming platform, website, and related services (the "Service"). We are committed to protecting your privacy in accordance with the General Data Protection Regulation (GDPR) and the national data protection laws of the European Union.

2. Data We Collect

We collect the following categories of personal data when you interact with the Service:

  • Account data: username, email address, and a hashed password when you create an account.
  • Profile data: display name, avatar, and any biography text you choose to provide.
  • Content data: videos, streams, chat messages, and comments you submit to the Service.
  • Usage data: IP address, browser type, device information, referring pages, and the pages you visit, collected through server logs and cookies.
  • Payment data: billing details processed by our payment service provider (PSP). We never store full card numbers on our servers.

3. Lawful Basis for Processing

We process your personal data under the following lawful bases as set out in Article 6 of the GDPR:

  • Consent (Art. 6(1)(a)): for setting non-essential cookies, sending marketing emails, and processing data you voluntarily provide.
  • Contract (Art. 6(1)(b)): to create and manage your account, deliver the Service, and process subscription payments.
  • Legal obligation (Art. 6(1)(c)): to comply with EU and German tax, accounting, and content-moderation laws.
  • Legitimate interests (Art. 6(1)(f)): to prevent fraud, ensure network security, and improve the Service.

4. Purposes of Processing

Your data is processed to: provide and maintain the Service; create and verify your account; process payments and issue invoices; personalize content and recommendations; communicate with you about your account; ensure platform security and prevent abuse; and comply with legal obligations.

5. Data Retention

We retain your personal data only for as long as necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. Account data is retained for the lifetime of your account and deleted within 30 days of account closure. Server logs are retained for 90 days. Payment records are retained for 10 years as required by German commercial and tax law (HGB/AO).

6. Your Data Protection Rights

Under the GDPR, you have the following rights regarding your personal data:

  • The right to access your personal data and receive a copy.
  • The right to rectify inaccurate or incomplete data.
  • The right to erasure ("right to be forgotten").
  • The right to restrict processing of your data.

  • The right to withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.

7. Data Sharing and Recipients

We do not sell your personal data. We may share your data with: our payment service provider (to process payments); our hosting and content-delivery providers (to deliver the Service); analytics providers (where you have consented); and public authorities, where required by law or to protect our legal rights.

8. International Data Transfers

As the Service is available across the European Union, your personal data may be processed in EU member states. Where data is transferred outside the EU/EEA, we rely on appropriate safeguards such as Standard Contractual Clauses (SCCs) approved by the European Commission, or on an adequacy decision for the destination country.

9. Security of Your Data

We use appropriate technical and organizational measures to protect your personal data, including TLS 1.2/1.3 encryption in transit, hashed passwords at rest, strict access controls, regular security audits, and server-side rate limiting. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

10. Cookies

We use cookies and similar technologies to operate and improve the Service. Essential cookies (including a session cookie that is set when you attempt to log in) are necessary for the Service to function and do not require consent. Non-essential cookies (analytics, marketing) are only set after you have given your consent. You can manage or withdraw cookie consent at any time through the cookie settings banner.

11. Children's Privacy

The Service is not directed to children under the age of 16. We do not knowingly collect personal data from children under 16. If you believe we have collected personal data from a child under 16, please contact us at privacy@sputni.live, and we will delete such data.

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or operational reasons.
